PURPOSE OF DATA PROCESSING
Merely browsing the website does not imply the processing of personal data by INDENET. If the interested party fills out the contact form, the requested data will be processed exclusively to facilitate, expedite, and fulfill the commitments established between INDENET, S.L. and the user, or to maintain the relationship established in the forms filled out by the user, or to address any request or inquiry from the user.
TRUTHFULNESS OF THE INFORMATION PROVIDED
It is the responsibility of the User to verify that the information provided is accurate and complete before making any decisions related to any service or content. Furthermore, the User will inform INDENET of any changes to their data to ensure it remains up-to-date throughout the entire processing phase.
LEGAL BASIS FOR DATA PROCESSING
The legal basis for the processing of personal data is the unequivocal and express consent, and the user commits to obtaining this consent by verifying the user for processing their personal data for one or more specific purposes.
The user has the right to withdraw their consent at any time. Withdrawing consent will be as easy as giving it. As a general rule, withdrawing consent will not affect the use of the Website.
In cases where the user must or can provide their data via forms to make inquiries, request information, or for reasons related to the website’s content, they will be informed if completing any of these forms is mandatory because it is essential for the proper execution of the operation.
RECIPIENTS OF THE DATA AND INTERNATIONAL TRANSFERS
To properly manage the service provided and the personal data of its users, INDENET, S.L. will collaborate with third-party service providers who may have access to the personal data on behalf of INDENET, S.L. due to their provision of services. INDENET, S.L. commits to entering into a corresponding data processing agreement with them, through which they will impose, among other obligations, the following: applying appropriate technical and organizational measures; processing personal data for the agreed purposes and following the documented instructions of INDENET, S.L.; and deleting or returning the data to INDENET, S.L. once the services are completed.
If the data controller intends to transfer personal data to a third country or international organization, the user will be informed at the time of collecting the personal data about the third country or international organization to which the data is intended to be transferred, as well as the existence or absence of a Commission adequacy decision.
PERSONAL DATA OF MINORS
In accordance with Articles 8 of the GDPR and 13 of the RDLOPD, only individuals over the age of 16 can provide lawful consent for the processing of their personal data. If the individual is under 16, consent from parents or guardians is required for processing, and this is only considered valid if authorized by them.
DATA RETENTION
The information required through the contact form will be kept for the necessary period to manage the inquiry or request for information. Afterward, the data will be blocked for the legal action prescription period. After this period, the personal data will be deleted.
EXERCISE OF RIGHTS
- Right of access: The User’s right to obtain confirmation of whether INDENET, S.L. is processing their personal data and, if so, to obtain information on their specific personal data and the processing INDENET, S.L. has carried out or is carrying out, as well as, among others, information about the origin of those data and the recipients of communications made or expected from them.
- Right to rectification: The User’s right to modify their personal data if they are inaccurate, incomplete, or not suitable for the purposes of processing.
- Right to erasure (“right to be forgotten”): The User’s right to request the deletion of their personal data when they are no longer necessary for the purposes for which they were collected or processed; the User has withdrawn their consent and there is no other legal basis; the User opposes processing and there is no legitimate reason to continue; personal data has been processed unlawfully; personal data must be deleted in compliance with a legal obligation; or the data was obtained from an offer of services of the information society to a child under 16 years old. In addition to deleting the data, the data controller must, considering the available technology and cost of application, take reasonable steps to inform other controllers processing the personal data of the request for deletion of any links to such personal data.
- Right to restriction of processing: The User’s right to restrict the processing of their personal data. The User can request the restriction of processing when disputing the accuracy of their personal data; the processing is unlawful; the data controller no longer needs the personal data, but the User needs it for claims; or when the User has opposed the processing.
- Right to data portability: If processing is carried out by automated means, the User has the right to receive from the data controller their personal data in a structured, commonly used, and machine-readable format and to transmit them to another controller. Where technically possible, the data controller will directly transmit the data to the other controller.
- Right to object: The User’s right to object to the processing of their personal data or to cease processing by INDENET, S.L.
- Right not to be subject to a decision based solely on automated processing, including profiling: The User’s right not to be subject to an individualized decision based solely on automated processing of their personal data, including profiling, unless required by applicable law.
Thus, the User can exercise their rights through a written communication addressed to the data controller, INDENET, S.L., specifying:
- Name, surname, and copy of the ID. In cases where representation is allowed, it will also be necessary to identify the representative in the same way, as well as the document accrediting the representation. A copy of the ID can be replaced with any other valid legal means that proves identity.
- Request with the specific reasons for the request or information the User wishes to access.
- Address for notifications.
- Date and signature of the applicant.
- Any document that proves the request made.
